Creating a Balance in Bilateral Investment Treaty: A Perspective from Indonesia

The previous movement of Government Indonesia (GOI) to terminate its expiring Bilateral Investment Treaties (BITs) with many countries does not mean like the end point rigorous policy. It then leaves a question mark about legal standing after concession and how government establishes new model create balance in BIT. This research is conducted to, firstly, analyze position foreign investor terminated Furthermore, it will discuss can take benefit through learning experience from mistakes old BITs latest development international investment law. Finally, this study focuses on BIT be achieved for both host state investor. result shows that did breach any law procedure particular by fathoming Vienna Convention Law protection diminish immediately due existence survival clause. Further investigation identifies obtain greater following termination, GOI should develop better balanced provisions next model. effort done taking care principle extraterritorial obligation, full security clause, indirect expropriation, regulatory measure most importantly deal dispute settlement.
